DURATION

1.

The competition commences 15 October 2006 and closes 31 December 2006.

ENTRY

2.

Entry is limited to individuals aged 18 years and older. However, some prizes may have additional age restrictions. Employees of the Promoter and their immediate families and employees of the competition sponsors and their immediate families are ineligible to enter.

3.

Sponsors of the competition include: CNN, Northwest Airlines, WebCarHire, OctopusTravel, Insight Guides, Naxos, Priority Pass and HotelClub.com

4.

The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these terms and conditions.

WINNERS AND PRIZES

Entrants must correctly complete an official competition entry form available at www.HotelClub.com/Asia and write in 200 words or less their favourite Asian vacation. Entries must be the original, independent creation of the entrant and free from any third party claims, including copyright or trademark claims. Entries must not: (i) have been published previously; (ii) have won prizes or awards in another competition or; (iii) contain information that is discriminatory, defamatory, and offensive or infringes any law or regulation.

6.

A total of eleven major prize winners will be chosen by the judges based on the reasons provided for their favourite Asian vacation. Weekly prize winners will be chosen by the judges each week based on the best reason for a favourite Asian vacation. The judges’ decision is final and no correspondence will be entered into.

Major prize winners will be selected on 15 January 2007 at 2pm at Level 28, 680 George Street, Sydney NSW 2000, Australia. Winners will be notified in writing and the winners names will be published on the HotelClub.com website by the 15 February 2007. It is a condition of awarding each prize that the winner must, if requested to do so by the Promoter, sign and return any affirmation of eligibility to enter, ownership of entry, or release and compliance statements provided to the winner by the Promoter. Prizes not claimed within 14 days of the date of the notification of the result of the competition will be deemed as “unclaimed” and the Promoter will select replacement winners from the remaining entries on 15 February 2007. This process shall be repeated until the Promoter has selected eleven confirmed winners.

Major Prizes: the best eleven entries will win a major prize as follows:

  1. one entrant with the best entry as decided by the judges will receive 500,000 WorldPerks Bonus Miles provided by Northwest Airlines.  WorldPerks Miles must be used in accordance with the terms and conditions set out by Northwest Airlines and cannot be redeemed for cash.  A) This promotion is jointly offered by HotelClub and Northwest Airlines. B) WorldPerks Bonus Miles will be credited to each winner's WorldPerks account 2 to 4 weeks from the date of announcement. Winners must provide a valid WorldPerks account number that matches the name entered in the draw. C) The number of award seats available for WorldPerks free travel awards is limited and subject to availability. D) Employees of HotelClub, Northwest Airlines, advertising agencies, vendors or anyone connected directly to the promotion are not eligible to participate. E) Winners will be selected in a drawing based on answer to competition question from all eligible entries received by 31 December 2006. Results will be posted on the HotelClub.com website by 15 February 2007 and winners will be notified individually. Drawings will be conducted jointly by HotelClub and Northwest Airlines. All decisions will be final and binding in all respects. F) If prize or prize notification is returned as undeliverable, such prize will be forfeited and an alternate winner will be selected based on answer to the competition question. G) Except where prohibited by law, by accepting a prize, winner(s) agrees that HotelClub and Northwest Airlines may use the winner's name, address, photograph, videotape, likeness and/ or prize information for advertising, publicity and promotional purposes and to the use of statements made by or attributed to winner relating to Northwest Airlines or to this sweepstakes and grants to Northwest Airlines any and all rights said use without limitation, without further compensation, or notice. H) No prize transfer or cash substitutes are allowed except at HotelClub and Northwest Airlines' joint discretion due to prize unavailability for any reason and only then for prize of equal or greater value. I) Fuel surcharges or any applicable taxes on the prize are the responsibility of the winner(s). J) HotelClub and Northwest Airlines have the final authority in the interpretation of the rules of this promotion.
  2. one entrant with the second best entry as decided by the judges will receive 300,000 WorldPerks Bonus Miles provided by Northwest Airlines. WorldPerks Miles must be used in accordance with the terms and conditions set out by Northwest Airlines and cannot be redeemed for cash.  A)This promotion is jointly offered by HotelClub and Northwest Airlines for residents of Asia. B) WorldPerks Bonus Miles will be credited to each winner's WorldPerks account 2 to 4 weeks from the date of announcement. Winners must provide a valid WorldPerks account number that matches the name entered in the draw. C) The number of award seats available for WorldPerks free travel awards is limited and subject to availability. One entrant with the fourth best entry as decided by the judges will receive USD $5000 worth of HotelClub “Member Dollars”. “Member Dollars” are distributed by HotelClub.com. “Member Dollars” can be redeemed for hotel reservations for hotels available on the HotelClub.com website only. Member dollars must be used in accordance with the terms and conditions set out on http://www.HotelClub.com/common/membership/MemConditions.asp, and cannot be redeemed for cash.
  5. One entrant with the fifth best entry as decided by the judges will receive USD $1000 worth of HotelClub “Member Dollars”. “Member Dollars” are distributed by HotelClub.com. “Member Dollars” can be redeemed for hotel reservations for hotels available on the HotelClub.com website only. Member dollars must be used in accordance with the terms and conditions set out on http://www.HotelClub.com/common/membership/MemConditions.asp, and cannot be redeemed for cash.
  6. One entrant with the sixth best entry as decided by judges will receive 7 days free car rental provided by WebCarHire.  WebCarHire car rentals must be used in accordance with the terms and conditions set out by WebCarHire.  Prize is valid for 12 months till the 15 DEC 2007 and is subject to availability, black out dates and specific depots.  Tthe car hire will include the car rental itself, unlimited mileage and tax.  Exclusions will be any optional extras, additional surcharges and fuel cost.
  7. Five entrant with the seventh best entries as decided by judges will receive 5 days free car rental provided by WebCarHire.  WebCarHire car rentals must be used in accordance with the terms and conditions set out by WebCarHire.  Prize is valid for 12 months till the 15 DEC 2007 and is subject to availability, black out dates and specific depots.  Tthe car hire will include the car rental itself, unlimited mileage and tax.  Exclusions will be any optional extras, additional surcharges and fuel cost.

WEEKLY PRIZES: Weekly prizes will be awarded for entrants with the most intersting entries decided by the judges for each week.  Weekly prizes will be drawn on the Monday of the following week at 2pm at Level 28, 680 George Street, Sydney NSW 2000, Australia. Winners will be notified in writing and published in weekly emails to all survey participants.  Weekly winners are also still eligible to win a major prize. 443 weekly prizes will be awarded during the promotion period including ; 80 x $100 worth of HotelClub Member Dollars, 3 x OctopusTravel vouchers, 200 x Insight Guides guidebooks, 20 x Priority Pass passes and 140 x Naxos Music Download subscriptions.

10.

The total prize pool is valued at up to USD 67,327.  Prizes’ value is subject to change due to exchange rates.  Prize providers are not liable to change prizes or make any compensation due to exchange rates.

LIABILITY

11.

If for any reason beyond the control of the Promoter, this competition is not capable of running as planned and the administration of this competition is affected, the promoter reserves the right to cancel, terminate, modify or suspend the competition by posting a notice to this effect at www.HotelClub.com.

12.

The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries.

13.

The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.

14.

The promoter reserves the right to seek damages to the fullest extent permitted by law for any deliberate attempt to damage any website or the information on a website, or to otherwise undermine the legitimate operation of this competition.

15.

Entrants are responsible for paying all costs associated with accessing the competition website.

16.

The Promoter shall not be liable for any loss, damage or loss of profit (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result or participating in the competition or consumption of prizes except for liability which cannot be excluded by law.

17.

The entrant consents to the Promoter, its related companies and the competition sponsors using comments made on the survey form, including placing such comments on its websites or third party websites. Unless expressly requested by the entrant to do so we may not acknowledge your authorship when posting comments.

18.

The Promoter makes no representations or warranties as to the quality, suitability, merchantability of any goods and services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained, to a person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission deliberate or negligent, by the Promoter or its servants or agents, in connection with the arrangement for supply, or the supply of any goods or services by any person to the prize winner and, where applicable to any family or persons accompanying a winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again. Winners and guests are responsible for having valid passports, travel insurance and spending money. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The prizes are not transferable, exchangeable or redeemable for cash. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the prize winner.

PERSONAL INFORMATION

19.

If the personal information requested by the Promoter on the survey entry form is not fully completed a person may not participate in the competition.

20.

Unless otherwise advised, upon entering the competition each entrant accepts that the Promoter, its related corporate bodies and the competition sponsors may use information provided on the entry form for future promotional, marketing or publicity purposes (including electronic messaging) without any payment or other compensation to the entrant. Personal details of the entrant will be shared with the competition sponsors. Entrants have the right to access and correct personal information, or request that their information is not provided to third parties and can do so by contacting the Promoter.

21.

Each entrant agrees that before giving the Promoter personal information of any other person besides themselves they have obtained the consent from the other person to provide such information. HotelClub accepts no responsibility for an entrant’s failure to obtain a third party’s consent to provide their personal information to us.

22.

Entrants consent to the use of their personal information by the Promoter, its related bodies corporate and the competition sponsors for marketing and promotional purposes in accordance with these terms and conditions. These terms supplement the HotelClub Privacy Policy and shall apply to the extent of any inconsistency.

GOVERNING LAW

24.

These terms and conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia. All entrants submit to the non exclusive jurisdiction of the courts of New South Wales.
